Starting from May, 2011 in accordance with the internal Order of the Department of the Federal Migration Service the new processing requirements for foreign employees, substituting the dismissed ones came into force.

Under the Decree of the Government of Russia № 925 as of November 17, 2010 the decree № 681 as of November 15, 2006, that regulated the procedures for notification of State organizations on foreign labor hire/dismissals (visa countries) lost it power.

On March 25, 2011 the Federal Law N42 as of March 20, 2011 “About the changes to the Federal law “On migration register (registration) of foreign citizens on the territory of Russia” and other legislative acts of Russia” came into force.

On January 21, 2011 within the order of "Rostrud" № 9, Quota for foreign labor hire 2011 has been adopted.

Starting from January 12, 2011, Quota 2012 applications are accepted by the Moscow Center for Labor Exchange at the new address.

Within the adoption of the Federal Law as of December 23, 2010 № 385, the changes to the Federal Law as of July 18, 2006 № 109 were implemented.

Within the adoption of the Federal Law as of December 23, 2010 № 385, the changes to Laws which regulate entry, stay and work of Highly Qualified Specialiscts on the territory of Russia were implemented.

This information refers to those Highly Qualified Specialists and their accompanying family members wishing to get residence permit in Russia within the adoption of Federal Law as of May 19, 2010 № 86, came into force in 2010.

According to point 14, article 13.2 of the Federal Law as of July 25, 2002  № 115, Highly Qualified Specialist and his family members are to be insured under the contract of Voluntary Medical Insurance from the day of their arrival to Russia.

The rules of medical care for foreign citizens on the territory of RF are approved by the Government Regulation № 546 as of the 1st of September, 2005.

Department of Federal Migration Service in Moscow region (Moscow, Solyanka Str., build.9) is no longer accepting the documents for migration register (registration) of foreign citizens in Moscow region.

Starting from January 1, 2011 the procedure of work permit documents submission in Moscow region has been changed.

According to the Order of the Ministry of Healthcare and Social Development N22N as of November 24, 2011 the list of Quota free positions for foreign nationals valid in 2011 was approved.

On July 28, 2010 the order N147 of the Federal Migration Service approved the new regime and application forms for FMS notifications on foreign labor hire by the companies which provide foreign employees in leasing.

According to the Federal Law 115 as of July 1, 2010 (paragraph 7.6, Article 13.1) FMS started to accept documents for work permit correction from the organizations which hire foreign citizens from visa free countries with valid work permits issued on behalf of some other organizations, and if work permit contains the name of the other company or does not contain any information about employer at all.

On September 7, 2010 the new order of the Ministry of Healthcare and Social Development № 514n of 13 July 2010 came into force. The order approves the new application forms for foreign labor hire Quota application and Quota correction application.

Quota for work permits in 2011 might be reduced up to 10% and will be 1 745 584.

Starting from January, 1 2011 the state fee for migration register (registration) and temporary stay extension of foreign citizens on the territory of Russia will be cancelled.

According to the Order № 482н as of 28 June published on 10 August, 2010 by Ministry of Healthcare and Social Development a number of new professions were added to the list of Quota  free positions in 2010.

Within the order of the Federal Migration Service of №147 of 28 June, 2010 the number of new notification forms on Highly Qualified Specialists’ labor activity were implemented.

Within the letter № 03-04-06/0-160 as of 27 July, 2010, the Ministry of Finance clarified the taxation rates question of Highly Qualified Specialists with dual citizenship (including RF one).

On July 28, 2010 the order N147 of the Federal Migration Service “About the new application forms and regime for notifications of state organizations on foreign labor hire for citizens from visa free countries” came into force, thus the Governmental resolution №183 of 18 March 2008 lost its power.

Let us introduce the latest changes of the migration legislation came into force  in July 2010 after the adoption of the Federal Law  №86 as of May, 19 2010.

In September 2009 in addition to the Federal Law № 109-ФЗ from July 18, 2006 “On migration register (registration) of foreign citizens in Russia” new FMS order № 159 from July 6, 2009 came into force. The new order determines the periods for processing, duties and order of FMS when applying for foreign citizens’ migration register (registration) in Russia.

In accordance with the order of Mr. Molodievskiy - the Head of the Federal Migration Service of Moscow region from August, 14 2009, migration register (registration) of foreign citizens can not be made by local FMS departments of Moscow Region any longer. For migration register (registration) of foreign citizens in Moscow Region a host party should apply to the Department of the Federal Migration Service of Moscow Region, located at the following address: Moscow, Solyanka str., 9A, building 1.

Starting from September 14, 2009 in order to obtain work permit in Moscow for the citizens from visa countries an employer should present to FMS the notary registered and translated into Russian Appostille of the foreign citizen’s educational certificate.

According to the information from the Moscow Center for Labor Exchange all employers will be able to use the confirmed for 2010 for them Quota for foreign labor hire not earlier than end of December 2009 at the time when the corresponding information (database) will be transferred to the Department of the Centers for Employment.
