Is it necessary to pay for a patent during the quarantine period?

In accordance with the Decree on measures to regulate the legal status of foreign citizens and stateless persons in Russia in connection with the threat of COVID-19 distribution, from March 15 to June 15, 2020, the validity of patents and other permits of foreign citizens will be temporarily suspended. This raises the question of what to do with monthly payments of the patent. Below is a table that will help you understand this topic:

The expiration of the patentComments
The patent expires between March 15 and June 15

Payment of the patent does not occur, the term of the patent is calculated according to the following formula:

Actual patent expiration date = June 16 + number of days from March 15 to the end of the patent validity date.

For example, the patent validity date 10.06.2020. The number of days from March 15 to June 10 is 87 days. Accordingly, actual patent expiration date: June 16 + 87 days = 11.09.2020.

Until this date, the patent will be valid and no payments need to be made.

At the same time, to extend the validity of the patent after 11.09.2020, you need to make another payment no later than 11.09.2020 (or better, a few days before this date, so that the Bank payment has time to pass).

It should also be noted that the total term of validity of a foreign employee's patent, including all extensions, cannot exceed one calendar year from the date of grant of the patent (clause 5 of article 13.3 of the Federal Law № 115-FZ Law of 25.07.2002).

The patent expires after June 15.This Decree applies only to those documents that expire between March 15 and June 15, that is, if the patent expires, for example, on June 16, then this date is the actual expiration date.
In this case, you must make payment for the period starting from July 17.
The patent expired before March 15.

This Decree applies only to those documents that expire between March 15 and June 15, that is, if the patent expired on March 14 or earlier, the term of this patent is not extended, so it will be considered no longer valid today.
However, in accordance with the same Decree, foreign citizens can work on the territory of the Russian Federation until June 15 without a patent.
