Requirements for notification of State organizations on foreign labor hire/dismissal (visa countries) 01.05.2011

Under the Decree of the Government of Russia № 925 as of November 17, 2010 the decree № 681 "On the regulations for foreign citizens temporary labor activity documents processing" as of November 15, 2006 lost its power. The old Decree regulated the procedures for notification of State organizations on foreign labor hire/dismissals (visa countries).

The Order № 610N as of October 30, 2008, being part of the Order № 681 as of November 15, 2006 also lost it power.

Unfortunately up to now, most local Centers for Employment of Moscow, Committee for Labor and Employment of Moscow region as well as Labor inspections of Moscow and Moscow region, cannot comment on the new Decree and supply organizations with correct information on the cases, periods and necessity of notification of State organizations (Center for Employment, Labor Inspection) on foreign labor hire/dismissal (visa countries).

It took a lot of time and efforts for Legal advisors of Confidence Group to communicate with officials of the below organizations on notification procedures.

Organizations contacted: 

  1. Center for Employment of the Central district of Moscow;
  2. Committee  for Labor and Employments of Moscow region;
  3. State Labor Inspection of Moscow;
  4. State Labor Inspection of Moscow region.

We managed to convince the officials of the organizations that under the Decree of the Government of Russia N925 as of November 17, 2010, organizations are no longer obliged to notify the local Center for Employment as well as the State Labor Inspection on hiring/dismissals of foreign citizens from visa countries.
The only obligation left is to notify Tax authorities within 10 working days from on one of the below issues of foreign citizens labor activity (applies to visa and visa free countries according to the sub-clause 4, paragraph 8, article 18 of the Federal Law № 115 of July 25, 2002).

They are:

  • Obtaining work permit;
  • Labor contract conclusion;
  • Foreign employee’s arrival to the place of work or place of stay;
  • Applying for the invitation letter for work visa; Suspension or cancellation of foreign labor hire permit;
  • Work permit cancellation.
