Medical examination of foreign citizens during work permits and other documents execution 23.06.2011

In May 2011 the draft of decree of the Chief State Medical Officer of Moscow N 9 as of May 13, 2011 was published. The decree regulates the new procedure for medical examination on HIV and infectious deseases of foreign citizens applying for work permits, temporary residence permits and residence permits.

Starting from July 1, 2011, HIV-test certificates can only be issued by the State or Municipal healthcare organizations. Thus the medical examination itself for HIV and other infectious diseases (approved in the law) can also be made in private healthcare organization but the latest have to transfer information to the State or Municipal healthcare organization in order to get the appropriate certificate.

Information on positive HIV, tuberculosis or other infectious diseases as well as drug addiction shall be transferred by the State or Municipal healthcare organizations to the Interdepartmental commission, established under the present Decree.

Interdepartmental commission shall decide whether Moscow has opportunity for treatment of a foreign citizen and whether it’s reasonable or not.

In case of a negative resolution of Interdepartmental commission, refusal or deviation from treatment by a foreign citizen, the commission develops and approves the draft of the document for "undesirability of foreign citizens" stay on the territory of Russia and passes it to the Department of the Federal Migration Service of Moscow for execution.

On the basis of resolution, the Department of the Federal Migration Service of Moscow has the right to cancel the appropriate foreign citizens documents including work permit or temporary residence permit and deport him from the territory of Russia.
