On December 21, 2012 the State Duma has approved the law on "Changes to the Federal law on legal status of foreign citizens in Russia" and on cancellation of sub clause "ж", Clause 5, Part 1 of the Federal Law as of May 19, 2010 on № 86-FZ on "Changes to the Federal law on legal status of foreign citizens in Russia and some other legal acts”.
According to the changes in the draft law, the documents for HQS work permits processing listed below can be applied through Internet, using the Common Government Services Portal of Russia. They are:
- Application form for HQS hire;
- labor or civil-law contract;
- guarantee letter for covering all expenses in of case foreign citizen’s administrative deportation.
In case the documents are submitted to the Federal Migration Service Department electronically an employer shall present the original forms within the period of application processing.
The Common Government Services Portal can be also used for:
- quarterly notifications on salary payment;
- notifications on unpaid leave providing for HQS for the period of more than 1 month within a year;
- notifications on cancellation of labor or civil-law contract;
- prolongation of HQS work permit with the following documents attached:
- application form;
- labor or civil-law contract;
- copy of medical insurance policy;
- document with personal income tax information (2NDFL).
In case the documents are submitted to the Federal Migration Service Department electronically an employer shall present the original forms within the period of application processing.
The Federal law will come into force after its official publication. On November 23, 2102 the draft law has been considered by the State Duma in the first reading.
