According to paragraph 13 of Article 13.2 of the Federal Law of 25.07.2002 № 115-FZ "On the legal status of foreign nationals in the Russian Federation" employers and customers of works (services) recruiting highly qualified specialists (HQS) must notify the territorial division for migration issues of the Ministry of Internal Affairs of Russia quarterly (not later than the last working day of the month following the reporting quarter) on the fulfillment of obligations to pay salaries (remuneration) to HQS.
For this purpose, notification of the payment of salaries or remuneration to the HQS for the 1st quarter of 2021 must be submitted no later than 30 April 2021.
We remind you that from 1 January 2021 the form and procedure for submitting notices of payment of HQS salaries has changed. The new rules were approved by Order No. 536 of the Ministry of Internal Affairs of Russia dated 30.07.2020.
You may submit a notification of payment of salary (remuneration) to the HQS in one of the following ways:
• in person (including by a representative under a power of attorney);
• by post (by registered mail with return receipt and list of enclosures);
• electronically (through the Public Service Portal using an enhanced qualified electronic signature).
Please note that the notification is a document confirming that the highly qualified person is paid at least the statutory salary level and it is the employer's (customer's) responsibility to submit it.
Therefore, failure to notify or violation of the established procedure and (or) form of notification is an administrative liability in the form of a fine ranging from thirty-five thousand to seventy thousand roubles for officials; from four hundred thousand to one million roubles for legal entities.
It is important to mention that liability is established for each identified case of violation of the form or deadline for submission of the document.
