Clarifications on organization of entry into Russia specialists in the industry of rare, rare-earth, precious metals and stones 08.04.2021

The Ministry of Industry and Trade of the Russian Federation in the letter № 14494/17 from 26.02.2021 issued a clarification on the issue of sending an updated form for the submission of lists of entry into Russia specialists in the industry of rare, rare-earth, precious metals and precious stones.
 
The Department of Metallurgy and Materials of the Ministry of Industry and Trade of Russia reminds that from the day of approval of the Order of the Government of the Russian Federation № 140-r of 30.01.2021 the Ministry of Industry and Trade of Russia is the executive authority responsible for sending the following lists of persons for crossing the border to the Federal Security Service of Russia and the Ministry of Internal Affairs of Russia:
  • persons participating in the setup and maintenance of equipment of foreign production (if in the jurisdiction of the Ministry of Industry and Trade of Russia there is an organization – customer of equipment of foreign production);
  • persons entering the Russian Federation, attracted to work as highly qualified specialists, as well as family members of these persons (spouses, parents, children, adoptive parents, adopted children) (if in the jurisdiction of the Ministry of Industry and Trade of Russia there is an organization – employer or customer of works (services).
These lists of persons are submitted to the Federal Security Service of Russia by sending them using the system "Unified Portal of State and Municipal Services (Functions)". This procedure involves uploading the lists to the system in the new form, which is attached to the letter.
 
Thus, when sending letters to the Ministry of Industry and Trade of the Russian Federation on assistance in organizing the entry of foreign nationals, a new completed form should additionally be attached. It is also recommended that information on foreign specialists should also be sent to the Ministry of Industry and Trade of Russia (the official email address is info_admin@minprom.gov.ru), including in an editable format to the email address: gabaraevaaa@minprom.gov.ru. 
 
The following scans of documents confirming the status of foreign specialists should be attached to the letter.
 
For highly qualified specialists:
  • passport;
  • visa (if present);
  • valid employment contract or civil law contract with the employer or customer of works (services);
  • work permit (if present).
For specialists participating in setup and maintenance of foreign equipment:
  • passport;
  • visa (if present)
  • civil-law contract related to the purchase of equipment;
  • valid employment contract or civil law contract for performance of works (services) with employer or customer of works (services);
  • work permit (if present).
Please note that the requirement to submit an employment or civil law contract was excluded by the Order of the Government of the Russian Federation № 3675-r of 30.12.2020, but, as follows from the above letter, it still refers to the recommended documents.
 
In addition, the above list of documents does not take into account the situation where there is no labor or civil law contract for works (services) between the specialist involved in the setup and maintenance of foreign equipment and the host organization, when the service is carried out within the contractual relationship between the foreign manufacturer/supplier and the organization.
