Review of draft Federal Law "On conditions of entry(exit) and stay(residence) in RF of foreign citizens and stateless persons" 02.06.2021

Currently, a draft federal law "On the conditions of entry (exit) and stay (residence) in the Russian Federation of foreign citizens and stateless persons" is under consideration.
 
We would like to overview three new concepts that will be brung into force. Firstly, the creation of a register of unscrupulous inviting persons. This register will include businesspersons and companies that help illegal foreigners to enter the Russian Federation, as well as individuals and legal entities, individual entrepreneurs who attract migrants to illegal activities. It's connected to the fact that deciding whether to hire a foreigner, the employer will be forced to act with greater prudence with regard to candidates. However, the consequences of including a person in this register have not yet been clarified. Most likely, this will lead to significant inconvenience, for example, if the company participates in a public procurement procedure.
 
Secondly, the creation of a “controlled stay” law enforcement regime. Upon entry, a citizen of another country will need to sign a loyalty agreement, i.e. formal informed consent on the conditions of entry into the country, namely, on responsibility to respect the Constitution of the Russian Federation and Russian legislation.
 
The controlled stay regime was created for the execution by foreigners of the measures of administrative coercion assigned to them and the prevention of the commission of offenses.
 
  • Mode of short stay. Assumes staying on the territory of the Russian Federation within 90 days per year.
  • Long-term stay regime. Assumes staying on the territory of the Russian Federation for more than 90 days per year without obtaining a permit for permanent residence.
  • Permanent residence mode. Assumes permanent residence in the territory of the Russian Federation and will be assigned indefinitely.
Thus, the Ministry of Internal Affairs plans to abandon the temporary residence permit.
 
Therefore, it will be possible to obtain a permanent residence permit in a general and simplified manner. Under the general procedure, a foreign citizen will need to pass an exam in the region where he/she intends to permanently reside.
