Clarifications on the mandatory vaccination of 60% of the staff 30.06.2021

The Operational headquarters of preventing the import and spread of a new coronavirus infection of Moscow and the head of the Office of Rospotrebnadzor in Moscow made explanations in connection with the incoming questions from employers about compulsory vaccination of 60% of employees of companies determined by the Resolution of the Chief health inspector of Moscow.
 
Firstly, it is worth noting that this decree also applies to foreign citizens working in the areas specified in it, whose vaccination in Moscow began on June 28, 2021 on a paid basis. To do this, the employer must submit an application. The fee for one employee is 1,300 rubles and is to pay by the employer. After the approval of the application, labor migrants can be vaccinated in the Sakharov migration center from 09:00 to 21:00, as well as on the territory of the Sadovod shopping center from 08:00 to 20:00.
 
These provisions apply only to those foreign citizens who do not have compulsory medical insurance. In the presence of compulsory medical insurance, such a citizen can be vaccinated free of charge along with citizens of the Russian Federation.
 
In addition, it is reported that trade includes not only retail trade, but also wholesale and distance trade, and public transport refers exclusively to public transport and taxis (passenger transport), which provides for the contact of employees with citizens-passengers.
 
Secondly, employees working remotely and self-employed, hired on the basis of contracts, are included in the total staff when determining the percentage of vaccinated.
 
In addition, in case of refusal to vaccinate in the absence of medical contraindications, the employee may be subject to suspension from work for a period of epidemiological trouble. This position is reflected in the letter of Rospotrebnadzor dated 01.03.2021 N 02 / 3835-2021-32.
 
During the period of suspension from work, the employee's wages are not charged, and the time of absence of the employee will not be included in the length of service, which gives the right to an annual basic paid leave (part 2 of article 121 of the Labor Code of the Russian Federation).
