Decree of the President of Russia of August 25, 2021 No. 493 "On the procedure for replacing positions of state and municipal service by citizens of Russia who have citizenship (nationality) of a foreign state, which has not been terminated for reasons beyond their control", it is determined that Russians with another foreign citizenship that have not for reasons independent of them, it is allowed to be hired on some state and municipal positions.
This Decree notes that such impossibility is established by a decision of the President of Russia or by the Commission on Citizenship Issues under the President of Russia, as well as describes the procedure for considering decision-making on this issue.
In addition, a list of actions has been determined that are allowed for such persons, despite the introduction of a ban by Federal Law of April 30, 2021 N 116-FZ "On Amendments to Certain Legislative Acts of the Russian Federation" for holding state and municipal positions for persons with foreign citizenship. So, they can:
- be accepted into the state or municipal service and appointed to positions without registration of admission to the state secret;
- continue to be in their positions, if they do not need admission to the state secret;
- be transferred, with their consent, to other positions in connection with a business need.
However, all of the above procedures are possible only on the basis of a fixed-term service contract for up to 3 years.
