The department of the Labor and Employment of Moscow, being responsible for Quota for foreign labor hire assignment informs about the following:
On January 28, 2013 the meeting of the Interdepartmental committee on cancellation of Quotas for foreign labor hire for 2013 took place in Moscow.
The Interdepartmental committee has audited organizations included into the Order of the Federal department of labor and employment as of December 24, 2012 N 279 "On approval the quotas for foreign labor hire in Moscow".
All organizations have been audited on compliance with the migration, labor and tax legislation. As the result, the decision to send to the Ministry of Labor Affairs of Russia the proposition to cancel Quotas for 2013 for the organizations, which had committed any of the following violations of the Russian law in 2012, has been published.
They are:
1. Violation of the labor law on conditions and protection of labor, including the fatal incidents on manufacturing;
2. Violation of the terms of salary payments;
3. Release of the positions filled by Russian workers in order to hire foreign citizens.
The list of the organizations, which Quotas in 2013 will be cancelled due to the above violations is available in the Application 1 to the protocol of the committee.
4. Violation of the tax legislation in case of the late tax payments (delays) or in case the organization is closed or is under the closing procedure (bankruptcy procedure).
The list of the organizations, which Quotas in 2013 will be cancelled due to the tax violations is available in the Application 2 to the protocol of the committee.
5. Failure to notify the local center for employment on foreign labor hire within the paragraph 9, article 13.1 of the Federal Law as of July 25, 2002 N 115-FZ "On legal stay of foreign citizens on the territory of Russia (visa-free citizens only).
The list of the organizations, which Quotas in 2013 will be cancelled due to the non-notification of the Center for Employment is available in the Application 3 to the protocol of the committee.
6. Non-compliance with the law of Moscow as of December 12, 2004 № 90 "Оn Quotation of working positions"(for those over 100 persons staff).
The list of the organizations, which Quotas in 2013 will cancelled due to the non-compliance to the law on working positions Quotation is available in the Application 4 to the protocol of the committee.
7. Failure to provide information on vacancies to the local Center for Employment.
The list of the organizations, which Quotas in 2013 will be cancelled due to the failure to provide Centers for Employment with information on vacancies is available in the Application 5 to the protocol of the committee.
To find your organization from the list click "Ctrl+F" and enter your organization's name or Tax Payer Number in the opened panel.
The Interdepartmental committee informs the organizations can adjust their violations up to February 02, 2013. This concerns violations indicated only in paragraphs 5-7.
The next meeting of the Interdepartmental committee will be held on February 21, 2013 on which the decision on Quotas for foreign labor hire cancellation will be made.
Quotas for foreign labor hire of those organizations who fail to adjust their violations will be cancelled, furthermore all work permits issued before will be cancelled.
