On May 23, 2013 the Draft law “On temporary suspension of the articles 13.1, 13.3, 18 и 18.1 of the Federal law 115-FZ as of July 25, 2002 “On legal stay of foreign citizens on the territory of Russia” for the period of 5 years.
The main idea of the draft law is supposed to be the provision of the optimum balance of the labor resources and priority promotion of Russian labor resources. In this connection issuing of work permits and patents for work can be suspended up to 5 years.
Exception is supposed to be made only to Highly Qualified Specialists, whose work permit obtaining procedure can remain the same.
Please consider the articles of the Federal Law 115-FZ which can be suspended by the new draft law:
- Article 13.1. Labor activity of foreign citizens, arriving in Russia on visa-free basis
- Article 13.3. Peculiarities of labor activity of foreign citizens hired by private persons (Patents)
- 18. Invitation letters for entering Russia with work purpose
- 18.1. Peculiarities of regulation of foreign labor market
To the introductory letter, the designers of the draft law provide the following decisions to solve the problem of the lack of labor resources: within first two years the problem can be solved by using the previously accumulated on the territory of Russia foreign citizens who succeeded to obtain work permits, patents for work, temporary resident’s permits. Further, the employers will be forced to compete for the labor resources, thus making the work conditions more attractive for non-qualified workers. This will allow to attract Russian workers, fulfilling the needs of the Russian labor market.
Confidence Group specialists estimate the probability of the adoption of the law as very unlikely, still the questions of the Quota for foreign labor cuts arise often.
To be on a safe side, one should take care of obtaining temporary resident’s permit as soon as possible.
The new law is supposed to come into force on December 31, 2013.
