AmCham Breakfast Briefing report 13.08.2007

The American Chamber of Commerce in Russia held a Breakfast Briefing on the 10th of August at the Marriot Aurora Hotel with Mr. Mikhail Antoshin, Head of Visa and Registration department of the Federal Migration Service for the city of Moscow.

Due to the position of the speaker the questions touched the specific issues of Migration Register/Notification procedure. Summarizing the meeting let me highlight the most interesting statements of the speaker:
 
A foreign citizen staying on the RF territory on the basis of residence permit or work visa does not need to Reregister (return his part of notification form to FMS) if he moves inside the RF territory for any period of his permit/visa validity. Still he does need to Register at a new place (notify the local authorities of arrival and departure) if he supposes to stay at this place for more than 7 working days.

A foreign citizen staying on the RF territory on the basis of work or multiple entry business visa, has to Register (notify the authorities of departure and arrival) every time he crosses the RF border for any period.

The Migration register procedure of a foreign citizen who has got his apartment in the ownership has to be done on the basis of the ownership certificate upon the personal application of this person to the post office or local FMS.

The documents for Migration Register/Reregister procedures should be accepted by all post offices upon personal application or on the bases of the power of attorney for the company’s representative (in case a person is registered on the business address).
   
Mr. Antoshin also stated that in practice many post offices set up their own rules that are contrary to the recently adopted new law. The speaker suggested in such cases to appeal to the Federal Migration Service and to himself.

Information for the accredited representative offices:
Migration Register/Reregister procedures should be done at any post office with the notification of the factual address of the representative office.

The period of the permanent stay in the RF under business visa and the maximum period for Migration register are still limited up to 180 days without leaving the country.

The procedure of company’s registration within the Federal Migration Service for the city of Moscow has been simplified. As a part of the old procedure there is no need to be registered within the local FMS first yet. The documents for registration should be submitted once to the Federal Migration Service for the city of Moscow.

The above procedures and rules are effective since the 15th of January 2007 within the adoption of the new federal law on “Migration register of the foreign citizens on the territory of the RF”. No further or new procedures have been mentioned by Mr. Antoshin.

Starting from the 1st of August 2007 the Russian government reduced the number of organizations registered within the Ministry of Foreign Affairs which had the right to issue TELEX invitations on their behalf. This situation caused limits or even refusals in applications at the providers of such services.
At the present moment the situation stabilized. The procedures and the period for TELEX invitation letter processing have not been changed: 3-4 working days for single and double entry TELEX invitation letters processing and 13-15 for multiple entry ones.
The procedures of obtaining the original invitation letters as far as Tourist visa support have not been changed. The average period for single and double entry original invitation letter processing is 14-16 business days, for multiple entry 21-23 business days and one day for Tourist visa support.
