Starting from November 3, 2013 the Order of the FMS №372 as of 05.09.2013 is coming into force. The order establishes the procedure of notification of the FMS made by employers on HQS’s salary payments, on the early labor contract termination or on unpaid leave for more than one month per year.
At that, the new procedure proper will be applied starting from January 1, 2013.
Employers are obliged to quarterly notify the FMS of Russia or its local authorized office that issued the HQS’s work permit on HQS’s salary payments (remuneration) not later than the last working day of the month following the reporting quarter. HQS’s salary payments (remuneration) shall be indicated in notifications as of the last day of the reporting quarter.
The Order also establishes time frames in which employer shall notify the FMS on termination of labor or civil contract or granting an HQS an unpaid leave for a period of more than one month per year.
An employer shall notify the FMS of Russia or its local authorized office that issued the HQS’s work permit within 3 working days upon terminating labor or civil contract with an HQS or granting an HQS an unpaid leave for a period of more than one month per year.
According to the approved Procedure a notification can be submitted on paper directly to the FMS of Russia or its local authorized office, sent via post services or submitted in the electronic form via Internet, including via “Common Government Services Portal of Russian Federation”.

The Order sets the form and the procedure of the FMS’ confirmation on receiving notifications. In case a notification is submitted directly to the FMS of Russia or its local authorized office, a notifier’s representative is given a certificate confirming the submission of the notification. In case an electronic notification is submitted, the FMS’s official sends the notifier an electronic message confirming the submission of the notification within one working day after notification submission.
