Foreign students in Russia 19.12.2013

On June 05, 2013 the draft law “On Amending the Federal Law №115-FZ as of 25.05.2002 “On the Legal Status of Foreign Citizens in the Russian Federation” has been introduced to the State Duma.

Earlier we published news which contained information on a draft law under consideration proposing the introduction of the new article 13.4 to the Federal Law №115-FZ as of 25.05.2002 “On the Legal Status of Foreign Citizens in the Russian Federation” which was to establish special conditions for citizens from visa-free countries with work permits and patents wishing to terminate their labor contracts.

The State Duma rejected the introduced redaction of the above mentioned draft law.

Instead of this draft law, on July 05, 2013 the State Duma adopted the Federal Law №203-FZ as of 23.07.2013 “On Amending the Federal Law “On the Legal Status of Foreign Citizens in the Russian Federation” and Certain Legislative Acts of the Russian Federation for the Purpose of Creating Additional Favourable Conditions for Foreign Citizens’ Study in the RF”, which introduced to the Federal Law №203-FZ as of 23.07.2013 “On Amending the Federal Law “On the Legal Status of Foreign Citizens in the Russian Federation” the new article 13.4 which covers peculiarities of undertaking labor activity for foreign citizens studying in Russia as full-time students.

According to the adopted law a foreign citizen studying in Russia as a full-time student at a professional educational organization or at a higher education organization and taking any basic professional educational program accredited by the State has the right to work under a work permit, except for the cases stipulated by this Federal Law.

The work permit is issued for a period of a foreign citizen’s labor contract but for not more than 1 year. Work permit validity shall not exceed the term of the foreign citizen’s study. Work permit can be renewed repeatedly for a period of a foreign citizen’s labor contract but for not more than 1 year each time.

The federal law comes into force on January 01, 2014 with the exception of certain articles of the law which came into force on the day of its official publication on July 25, 2013.
