FMSD of Moscow (Korneychuka str., 47A) – difficulties, delays, innovations 25.03.2014

Starting from February 2014, a number of changes connected with new amendments to migration legislation and implementation of new database have been introduced in the Federal Migration Service Department of Moscow (Korneychuka str., 47A) recently.

We would like to remind you that on February 2014 FMS of Russia (V. Radishchevskaya str., 4,bld.1) has stopped receiving the documents for Highly Qualified Specialists’ work permit application and delegated it’s functions to local FMSD which already had problems with receiving the documents for work permit application.

Due to this a big queues of about 220 people daily are trying to apply for work permits for citizens from visa countries (including HQS) to the FMSD of Moscow and only about 30 of them succeed every day. As a result it can take up to one week before one can apply for work permit. Moreover, it is necessary to confirm your presence in the queue at 1.00 p.m. and 5.00 p.m. A person can now apply to FMSD of Moscow with not more than 3 sets of documents (from different organizations or types of work permits). There is still a possibility to apply with one set of documents, it will take a less time.

The procedure of receiving the documents for issuing foreign labor hire permit and work permit has changed. Starting from March 19, 2014 the procedure of applying for foreign labor hire permit and work permit has been changed. Now the document for work permits cannot be submitted to FMSD of Moscow region together with the documents for foreign labor hire permit. It is necessary to get the foreign labor hire permit first.

Starting from March 21, 2014 the procedure of applying for work permit for Highly Qualified Specialists from Ukraine has been changed. At the present moment the prior approval of FMSD of Moscow (B. Ordynka str., 16, bld. 4) is necessary before applying for work permit. An employer has to get the additional resolution from the deputy head of the FMSD of Moscow – Mr. Nazarov Nikolay Petrovich.

The official "resolutional" working day of Mr. Nazarov is the second Thursday of each month, from 10 a.m. to 1.00 p.m. One can try to apply for resolution in other days too. Documents are accepted at the following address: B. Ordynka str., 16, bld. 4, office 314.

It takes from 4 to 7 days to get the resolution, after that the documents for HQS work permit can be submitted to the FMSD of Moscow (Korneychuka str., 47A).

The procedure of applying for work permit for citizens from visa-free countries has also been changed. Now the additional resolution on the documents from Mr. Sergienko Dmitry Vladimirovich, the head of Labor Migration department of the FMSD of Moscow, or from Mr. Dudnik Igor Nikolaevich,  the deputy head of Labor Migration department of the FMSD of Moscow, is necessary before applying for work permit.

The official working hours of Mr. Sergienko and Mr. Dudnik are Monday and Thursday, from 2.00 p.m. to 4.00 p.m..

Only after getting this resolution the documents for work permit can be taken into consideration.

The period of work permits (including standard procedure, foreign labor hire and HQS) processing has increased. Now it can take up to one extra week to obtain work permit after the documents are received.

The period of work permits for citizens from visa free countries processing comes up to 17 working days instead of 10 working days approved by the legislation.

While paying the state fee for work permit for citizens from visa-free countries, please note that the payer and his/her address in the receipt shall be the same as of the work permit applicant.

Starting from March 2014, the FMSD of Moscow clarified the system of picking up the Individual Taxpayer Number (INN). Now all foreign citizens are not obliged to pick up the Individual Taxpayer Number by themselves. The FMSD gets it electronically from the local tax inspections and puts the appropriate information into the foreign citizens’ work permits close to the ID number.

To the moment the Individual Taxpayer Number is put only into the work permits of the Highly Qualified Specialists but soon the system will start working and the procedure will be standard both for citizens from visa countries and for citizens from visa-free countries.

The Russia State Duma plans to consider one of the draft laws aimed to restrict FMS to admit the documents for work permits and patents for those citizens from visa-free countries, who failed to indicate the purpose of visit as “Work” in the migration card when crossing the Russian border.
