Center for Employment – new application procedure for foreign labor hire 12.08.2008

On August 11, 2008 in accordance with the Interdepartmental Law (№1/4/1/2 dated July 24, 2008) the State Department for Employment has changed the procedure of obtaining foreign labor approvals from the Centers for Employment.

The Employer is still obliged to apply for foreign labor approval (within valid Quota) at the local Centers for Employment. According to the new regulation, Centers for Employment do not process the applications for commission at the State Department for Employment. Starting from now, the functions of the Centers for Employment will consider the application for foreign labor hire approval and assist the employer in fulfilling the vacancies.

According to the Constitution of the Russian Federation, Russian citizens have the priority in fulfilling the vacancies. It means that Centers for Employment will be considering and sending first Russian applicants to fulfill the vacancies on which an employer is going to hire foreign labor.

An Employer has the right to submit the documents for work permits to the Federal Migration Service only after a 30 days period expiration from date of application to the Center for Employment.

Failure to meet this requirement will cause the refusal in issuing work permit for a foreign citizen.
