Confidence Group is pleased to inform you about the current situation in the FMSD of Russia in Moscow.
To the moment, the procedure of applying for foreign labor hire permit and work permit presenting of documents of foreign citizens from visa countries, including Highly Qualified specialists, includes a preliminary list and sometimes even live queue. A real opportunity to apply for work permits exists only in case of staying in the queue of the previous day at 5.00 - 7.00 p.m.
Recently the representatives of the FMSD have started to tear a pre-compiled list of applicants, thus presenting of the documents was possible only in case of constant queuing from 5.00 p.m. to 6.00 p.m. of the previous day. Short-term leaving from the queue could be the reason of failing of presenting of the documents.
The officials of the FMSD accept the documents for work permits for citizens from visa countries in 2 - 4 windows. The maximum number of sets of documents presenting by one representative can’t exceed 3 units. One Highly Qualified specialist or one foreign labor hire permit (excluding the number of foreign citizens) or an unlimited number of work permits from one organization (within one foreign labor hire permit) are understood as one set of the documents.
Currently it takes at least 15-20 minutes to the FMSD employees to process one set of the documents. Not more than 15-20 representatives of organizations are happy to apply for work permits daily.
The queue for the representatives of the organizations applying for work permit with one set of documents moves a little bit faster, but pre-registration is carried out in living queue.
As of May, 22 the new changes to the application procedure have been introduced by FMSD officials. One can apply for work permit only on the coupon, which are distributed by the FMSD official at 09 a.m. The total number of coupons per day can not exceed 40. The queue is not separated on those who apply with 1 or not more than 3 sets of documents.
As of May, 23 the FMSD officials distributed only 20 coupons instead of 40. So at the moment applying for work permit is limited to a minimum.
The representatives of the FMSD allow themselves to make their own decision about the qualifications of foreign workers and compliance to the certain positions when applying for work permit.
The FMSD official started to pay much attention to the education of foreign citizens hired within the quota-free positions. According to the FMSD officials education of foreign citizens to be hired on the technical (quota-free) positions must fully correspond to the intended work on certain position.
There were such cases when the FMSD officials refused to collect the documents for work permit on the position "Engineer on protection of information" with the foreign citizens' diploma of Technical University on specialty "Physics". According to them a diploma of higher education in the tourism and hotel business is not enough for obtaining a work permit and work on the position of "General Director" if the type of activity of the organization is different from the professional education of its head.
The FMSD officials focus on the education of foreign citizens from visa-free countries to be hired on the quota-free positions too.
Delays in the processing of documents for work permits and foreign labor hire permits amount 3- 5 working days.
Almost every 2-3 days, the FMSD database "falls" for the period from 2 to 5 hours. Documents are not processed within this period.
On May 22, 2014 work permit applications for HQS have not been accepted due to the technical problems at all.
It can take half of a day for Highly Qualified Specialists to collect their work permit.
Queues for presenting the documents for work permits for citizens from visa-free countries are much shorter at the moment.
The problems with applying for work permits for citizens from visa countries (most of them Qualified or Highly Qualified specialists) exist already more than half a year. The situation has been changed at all.
The heads of FMSD of Moscow do not pay any attention to the numerous complaints and make absolutely no efforts to improve the procedure of applying for work permits. The law-abiding employers suffer from it most of all.
