Starting from January 1, 2015 the procedure of foreign labor hire in Russia will be cordially changed. On November 27, 2014 corresponding Federal law as of November 24, 2014 N 357-FZ "On Amendments to the Federal Law" On Legal Status of Foreign Citizens in the Russian Federation "and some legislative acts of the Russian Federation" was published on the website of the Rossiyskaya gazeta.
Among other changes which oblige foreign citizens from visa-free countries to obtain patent for work on the territory of Russia, changes to the procedures of FMSD quarterly notifications on HQS foreign labor hire have been introduced.
At the moment employers must submit the following notifications to FMSD quarterly not later than the last day of the reporting quarter:
- on HQS salary notification;
- on HQS notification of termination of labor relations;
- on HQS notifications of vacations without payment for more than one calendar month during the year.
Starting from January 1, 2015 employers will be obliged to quarterly notify FMSD only on HQS salary notification. Other quarterly notification obligations will be abolished.
Article 18.15 of the Code of Administrative Offences of Russia has been also changed.
On those employers who fail all the requirements of the notifications on HQSs’ salary payments the administrative fines can be imposed.
We would like to remind you that according to the Order of the FMSD as of 18.08.2014 № 489 «On Amendments to the Appendices 7, 8 and 11 to the order of the FMSD of Russia as of June 28, 2010 № 147 "On forms and notifications of the FMSD about foreign labor hire on the territory of the Russian Federation" the following application forms (notifications) on HQS foreign labor hire have been changed:
- Application form for HQS salary notification is available here;
- Application form for HQS notifications of vacations without payments for more than one calendar month during the year is available here – will lose its powers in 2015;
- Application form for HQS notification of termination of labor relations is available here - will lose its powers in 2015.
