In September 2009 in addition to the Federal Law № 109-ФЗ from July 18, 2006 “On migration register (registration) of foreign citizens in Russia” new FMS order № 159 from July 6, 2009 came into force. The new order determines the periods for processing, duties and order of FMS when applying for foreign citizens’ migration register (registration) in Russia.
Please consider the latest changes and practical advices on how to avoid problems with the FMS.
The new order specifies and broadens the phrase “Host party” implemented in the Federal Law № 109-ФЗ from July 18, 2006 “On migration register (registration) of foreign citizens in Russia". From this moment the Host party might be one of the following organizations as well as any private person, registered in Russia:
- Any legal entity;
- legal entity’s branch or representative office in Russia;
- federal law entity;
- state organization;
- local authorities;
- diplomatic representation or foreign Consulate in Russia;
- international organization or its’ representation in Russia.
The new order determines the working hours of local FMS departments on migration register applications.

The new order specifies the list of the documents necessary for migration register applications, highlighting the peculiarities when preparing and delivering them to FMS.
The list of the documents have not been changed. One should still present the following documents:
- Copy of applicant’s passport;
- Copy of applicant’s migration card and visa;
- Copy of Russian citizen’s passport in case of registration within a private address;
- Copy of the authorized person’s passport in the host organization (for legal entities);
- 1 notification of arrival form – to be filled in block letters. Any kind of correction is not allowed, such forms will not be processed;
- In case of registering a foreign citizen through a post office, 2 notification of arrival forms are needed.
In some cases a foreign citizen can deliver all documents necessary for migration register to FMS by himself. In this case, along with the other documents he has to present the documentary proof of the reasons, why a host party cannot do it.
Local FMS department has to make a record in the State Informational System for Migration register within 3 working days from the date of application's registration .
The order also gives the right to any person to apply to FMS for a written consultation and obliges FMS to give the written answer within 30 days from application date.
