The obligation of employers to register an employee in the personified accounting system 15.08.2019

Confidence Group Company announces the provision of services to employers in registering an individual personal account in the system of individual (personalized) employee records.
 
In accordance with the Federal Law as of 01.04.2019 N 48-ФЗ, the Federal Law "On individual (personified) accounting in the compulsory pension insurance system" has been amended based on which all employers are required to register an individual personal account in the individual (personalized) system) accounting for all its employees, including foreign ones.
 
Registration in the system of compulsory pension insurance is subject to citizens of Russia, foreign citizens temporarily staying in the territory of Russia, as well as foreign citizens and stateless persons permanently or temporarily residing in Russia.
 
In addition, highly qualified specialists can be registered in the mandatory pension insurance system (hereinafter - the OPS) (for the possibility of their access to electronic services providing state and municipal services) without further accounting for pension rights.
 
Registration of the mandatory pension insurance system for highly qualified specialists becomes mandatory in the event of the conclusion of an employment contract.
 
Since April 1, 2019, in accordance with the updated Art. 65 of the Labor Code of Russia to conclude an employment contract, all persons entering the work, including highly qualified specialists, are obliged to provide the employer with confirmation of their registration in the OPS system.
 
In the event that an individual personal account has not been opened for a person entering work for the first time, the employer shall submit to the appropriate territorial body of the Pension Fund of the Russian Federation information necessary for registering specified person in the individual (personified) accounting system.

Failure by the policyholder to fail to provide, or to provide, incomplete and (or) false information provided for in paragraphs 2 - 2.2 of Article 11 of this Federal Law

Financial sanctions apply in the amount of 500 rubles in respect of each insured person

Failure to submit within the time period established by the legislation of Russia on individual (personified) accounting in the OPS system or refusal to submit to the Pension Fund bodies of Russia the information (documents) completed in the established manner necessary for conducting individual (personified) accounting in the OPS system, as well submission of such information in incomplete or distorted form

An administrative fine on officials in the amount of 300 to 500 rubles

In the event of the conclusion of an employment contract with a highly qualified specialist after April 1, 2019, non-compliance with the prerequisite for the provision of a document confirming registration in an individual (personalized) accounting system, including in the form of an electronic document

An administrative fine of 1000 to 5000 rubles; for legal entities - from 30,000 to 50,000 rubles

 

For this reason, it is recommended to register in the OPS system for all employees, including highly qualified specialists.
