Migrants will not be able to enter Russia due to previous offenses 05.07.2021

The Constitutional Court of the Russian Federation confirmed the right of the Ministry of Internal Affairs of the Russian Federation not to allow foreign citizens to enter the territory of the Russian Federation due to previous offenses for which they previously escaped responsibility and then legally stayed in the country.
 
In its Decision of May 20, 2021, the Constitutional Court recognized the decision of the Main Directorate of the Ministry of Internal Affairs of the Russian Federation for the Perm Territory to ban a citizen of Uzbekistan of the enter the Russian Federation for a period of 5 years, as a legal and thereby created a precedent.
 
This foreign citizen violated the period of stay on the territory of the Russian Federation in 2017, then returned to the Russian Federation in 2018 and left for his homeland without violations, however, when trying to return to Russia in 2019, he found that he was prohibited from entering the territory of Russia for 5 years, although he did not receive any notification of this and this decision was made out of court.
 
The Constitutional Court ruled that the Ministry of Internal Affairs of the Russian Federation acted within its powers, and the absence of violations in 2018 does not affect the correctness of the decision in 2017. It also states that the decision of the Ministry of Internal Affairs to ban entry can be made over the past period in which a foreign citizen violated length of stay. According to lawyers, this definition aggravates the situation of foreigners, since challenging any cases of prosecution for violation of the regime of stay becomes meaningless.
 
In addition, some foreign citizens faced entry bans due to the non-renewal of registration after March 15, 2020, which, according to the Presidential Decree, should have been renewed automatically.
