From 04.04.2022 the Government of Russia allowed the transfer of employees to another employer for the duration of the sanctions 13.04.2022

On March 30, 2022, by its Decree No. 511 dated March 30, 2022, the Government of Russia approved the features of the legal regulation of labor relations and other directly related relations in 2022.
 
Now, with the written consent of the employee, an employer who has temporarily suspended its activities in Russia can transfer such an employee to another employer in the same or another locality in the direction of the state institution of the employment service of the settlement.
 
At the same time, for the period of temporary transfer of the employee, the operation of the initial employment contract is suspended, but not interrupted. Please note that at the moment there is no concept of “suspension of an employment contract” in the Labor Code of Russia, and therefore, before clarification, there are no clear instructions on what suspension means for the employer himself.
 
With another employer, in the event of a transfer, the employee concludes a fixed-term employment contract with the possibility of its extension by agreement of the parties no later than December 31, 2022, with the consent of the employer with whom the original contract was concluded.
 
This procedure is valid from 04 April 2022 to 31 December 2022.
 
However, this resolution does not indicate whether it is possible to apply it to foreign citizens, in connection with which we sent a request to the Ministry of Internal Affairs of Russia on this issue, and we will notify you of their explanations.
